Companies that prevent conciliation will be fined up to 50,000 euros

The Congress gives the green light to process a law of labor equality between men and women, with fees and penalties for non-compliance

The plenary session of the Congress gave green light Tuesday, practically unanimously, to the processing a proposal of law of the PSOE to guarantee the effective equality between men and women in the work. One of the major novelties that it includes is a regime of infractions and sanctions of up to 50,000 euros for companies that prevent conciliation.

Thus, employees will have the right to leave for the care of their children and to reconcile their work and family life , in addition to ensuring that women can promote properly. These issues relating to the care of children or the suspension of indefinite contracts for maternity will refer to work both public and private and autonomous.

Establish economic sanctions if these measures are not carried out is the true step forward of this future law, because the recommendations of recent years will become obligations at the risk of committing an infringement. The socialist deputy and president of the Equality Commission, Pilar Cancela , explained it by stating that "mere declarations are not enough" because "effective tools for compliance" are necessary.

The articles include three types of sanctions : mild, serious and very serious. The Labor and Social Security Inspectorate will be the body that determines in which category each infraction is framed. And this will establish the scale of economic fine, which however will take into account factors such as the size and turnover of the company and the number of employees. In this way it will be between 60 and 625 euros for minor offenses, from 626 to 6,250 euros for serious and from 6,251 to 50,000 euros for very serious behavior.

Female director fee
Also, the rule of 49 articles will force to include a female quota in the decision-making bodies of companies and will fine those that terminate a contract during the pregnancy of an employee, among other situations to be prohibited. Despite this, the opposition considers it only "a patch" and already announced amendments to modify the text.

Reviewing all labor regulations, this initiative affects seven laws, three royal decrees and seven community directives, seeking to "reverse" the situation of discrimination suffered by women in the labor market, explained Cancela. «Only 7.67% of men take a reduction in working hours» for care or family reconciliation, which means that the gender gap in Spain is 11%, the salary difference 22% and 64% the workers with the lowest salaries are women. They are devastating data, "said the Socialist deputy.

The opposition has supported the processing of the law in any case, but they defined it during the debate as "confused", "patch" or only "good intentions" . In addition, the majority advised that they will propose changes during the debate in the Work Commission. The PP Equality spokeswoman, Carmen Dueñas, defended the "absolute" commitment of her party to equality and wanted to remember that with the Government of Mariano Rajoy "all female employment destroyed by the crisis" was recovered, achieving "the greatest number of women working »in the history of Spain.

We can also announced that they will "improve" the text while criticizing that this reform does not bring "executive" measures to move forward with respect to the current Equality Act, passed in 2007. Your spokesperson in this debate, the deputy of En Marea Yolanda Díaz said that the initiative presented is "a declaration of intentions", "abounds in measures that are not new" or that already exist and, in addition, "obviates equality in Social Security and pensions," among other aspects.

The PNV, meanwhile, asked the Government why this issue is so important and with such an integral treatment, a bill has not been submitted.
